Ives & Associates has broad experience representing both
corporations and employees in employment law cases. When representing employees,
we ensure that terminated or threatened employees’ rights have not been
violated. Virginia, Maryland and D.C. all adhere to the “at-will” doctrine which
permits terminations of employment without cause. Nevertheless, we have been
successful in winning or settling numerous claims by utilizing such laws as the
Americans with Disabilities Act (“A.D.A.”), the Civil Rights Act of 1964 (“Title
VII”), the Family Medical Leave Act (“FMLA”), the Age Discrimination in
Employment Act (“ADEA”) and the Fair Labor Standards Act (“FLSA”). We have also
helped employees protect themselves against unduly restrictive covenants not to
compete.

Virginia law requires that couples getting divorced live separate and apart for six months if they have no minor children (under the age of 18), and for one year if the couples have minor children. There are exceptions to this rule in cases of divorce for cause which includes spousal abuse and adultery.
It is much less expensive to obtain a divorce based on living separate and apart than it is to litigate a long, protracted, contested divorce based on cause.
Many people do not realize that a party can obtain temporary child support or alimony, or both, before the separation period is completed. Similarly, many clients are unaware that a couple can live separately in the same home - if both agree that they were truly living separate and apart (ie. they did not engage in sexual relations, and lived as roommates not as husband and wife).
Another aspect of family law that the average person does not understand is the distribution of assets. Virginia is an equitable distribution state. This means that in many occasions, a judge may choose to simply divide the parties assets up evenly - but a judge is not required to do so as they are in a community property state. In recent years, Virginia courts have adopted the position that parties may trace back separate property and money so that they can recover this money during the divorce.

4. Personal Injury/Auto Accidents:
Most people do not understand their rights with respect to personal injuries they suffer due to another person’s acts of negligence and intentional acts of wrongdoing. Such acts of negligence include, but are not limited to automobile accidents and slip and fall injuries.
One of the most misunderstood aspects of personal injury cases involves medical payments. If you are injured, call your insurance company to determine whether you have medical payments coverage (this is similar to a mini-health insurance policy built into your auto insurance). If you do, you can use this money to obtain reimbursement for your medical bills. If you have more than one car included in the same policy, you can “stack” this insurance to obtain double (for two cars) or triple (for three cars) the amount of this insurance coverage. Typically medical payment coverage is between $2,500 and $5,000 per vehicle. Furthermore, you can usually obtain reimbursement for these medical bills even if you have already received payment for these same bills through your health insurance.
Ives & Associates will assist you in obtaining your medical payment coverage even though we do not seek compensation for this service. We will further assist you in obtaining fair compensation for your damaged automobile without charge. Our law firm only receives compensation in personal injury cases if we obtain a settlement or judgement from the party that caused your injury, or his or her insurance company.
Many people also do not realize that you are entitled to much more than simply reimbursement of your medical bills in accident cases. We additionally seek compensation for: your pain and suffering, lost wages and in certain cases punitive damages against the negligent party.

Many people will find themselves in traffic court at one time or another in their lives. You have to make the decision whether it is worth it for you to have competent legal counsel accompany you. For red light or simple speeding tickets, you may want to take a chance and go to court without a lawyer. However, if you are facing a driving while intoxicated (“DWI”) charge, reckless driving charge, or if you have already had your license suspended or revoked, you should seriously consider retaining an attorney to represent you in court. DWI and reckless driving charges can result in your loss of license for a year or more. Since we have become a mobile society, it is very difficult to retain employment if you cannot drive to and from, and during, work hours.
With a competent attorney, you stand an excellent change of obtaining a restricted license, even if convicted. A restricted license permits you, among other things, to drive to and from your job, to and from your school, and to pick up a child at daycare..
